Terms and Conditions (T&C)

This English version is provided for convenience only. In the event of any discrepancy, the German version shall prevail.

1. Scope

These General Terms and Conditions (T&C) apply to all offers and contracts between Nicole Bedraoui · Human Design (hereinafter “we”) and our customers. This includes in particular:

Terms of the customer that deviate from these T&C are not recognized unless we agree to them in writing.

2. Conclusion of contract

2.1 Offer

The presentation of the services on this website is not a binding offer but an invitation to submit an inquiry.

2.2 Inquiry

With your inquiry (e.g. by email or via a form) you express your interest in a reading. Written readings and any additional appointments are arranged individually on request.

2.3 Acceptance

After your inquiry you will receive our offer by email with the service, price and payment information. Your inquiry and our automatic confirmation of receipt do not yet constitute a paid order. You accept the offer by paying; the contract is concluded with the payment. We confirm the order to you by email with the contract information, these T&C and the withdrawal notice.

3. Prices and payment terms

3.1 Prices

The following prices apply:

For the Advanced Reading we state the specific price in our offer by email before the contract is concluded (see clause 2.3). Here too, the contract is only concluded by your payment.

All prices are final prices. In accordance with § 19 UStG (German VAT Act), no value-added tax is charged (small-business regulation). Price changes apply only to contracts concluded after the date of the change.

3.2 Payment

After your booking you will receive a payment link via Stripe. For online coaching and personal readings via Zoom, we send you the link a few days before the agreed appointment. Payment must have been received before the appointment; the conversation then takes place via Zoom.

Written readings are prepared after receipt of payment and then sent by email. You will find the delivery time in clause 4.

4. Delivery of the written reading

After payment has been made, the written reading is prepared individually for you and provided by email as a PDF file. Delivery usually takes place within approx. 10 to 14 days after receipt of payment and once your birth data is available.

The reading you receive is intended for your personal use. Passing it on, copying it or using it commercially is not permitted without written consent.

5. Withdrawal notice

5.1 Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (Nicole Bedraoui, c/o IP-Management #9553, Ludwig-Erhard-Straße 18, 20459 Hamburg, Germany, email: info@live-your-humandesign.com) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You can also use the electronic withdrawal function. You can use the attached model withdrawal form for this, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send the notice of exercising the right of withdrawal before the withdrawal period has expired.

5.2 Consequences of withdrawal

If you withdraw from this contract, we must reimburse all payments we have received from you without undue delay and no later than fourteen days from the day on which we received the notice of your withdrawal. For this repayment we use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment.

5.3 Premature expiry of the right of withdrawal

Individually prepared written reading: Your right of withdrawal remains in place during the fourteen-day period. We do not treat it as expired merely because we begin preparing the reading or you receive a PDF file.

Online sessions (reading/coaching as a service): For a contract for the provision of services, the right of withdrawal expires once we have fully performed the service, provided we only began performing it after you gave your express consent and at the same time confirmed that you are aware you will lose your right of withdrawal once the contract has been fully performed (§ 356 (5) BGB, German Civil Code).

6. Online appointments, delivery and cancellation

6.1 Scheduling

Personal readings via Zoom and additional online sessions are scheduled individually on request. Here too, the conclusion of the contract is governed by clause 2.3; arranging an appointment alone is not yet a paid order.

6.2 Cancellation by you

You can cancel by email to info@live-your-humandesign.com. The following deadline applies:

The scheduled start of the appointment is what counts. If you cancel in time, any amount already paid will be refunded. We process refunds manually. They are made to the means of payment originally used or, if you expressly agree, by bank transfer; this incurs no fees for you. If you cancel late or do not show up, there is no entitlement to a refund; you remain free to prove a lower loss. The statutory right of withdrawal under clause 5 remains unaffected.

6.3 Changes of appointment / rebooking

There is no entitlement to automatic rebooking. Requests to change an appointment can be made by email in individual cases and are considered individually.

6.4 Cancellation by us

If an agreed appointment has to be cancelled for reasons we are responsible for, we will inform you as soon as possible. In this case we offer, at your choice, a replacement appointment or a full refund of any amount already paid.

6.5 Conducting the online sessions

If online sessions take place, they take place by video call. You are responsible for the technical requirements for taking part, in particular a stable internet connection and a working device. If the session cannot take place, or can take place only in part, because of technical problems on your side, there is generally no entitlement to a refund. Statutory claims remain unaffected.

7. Limitation of liability

7.1 Liability

We are fully liable for intent and gross negligence and for injury to life, body or health. In cases of slight negligence we are liable only for breach of essential contractual obligations (cardinal obligations); in this case liability is limited to the foreseeable damage typical for this type of contract.

7.2 Liability for content

All content of the readings and coaching is provided to the best of our knowledge and belief. For liability in connection with this content, the rules and exceptions in clause 7.1 apply.

8. Disclaimer: nature of the services

8.1 Important notice

Human Design is a system of self-exploration and reflection. Readings and coaching serve personal orientation, inspiration and entertainment. They are not medical, psychological, psychotherapeutic, healing-practice, legal or financial advice and do not replace such advice.

8.2 No promises of healing

No healing, no diagnosis and no specific results are promised or guaranteed. For health, mental health or legal concerns, please turn to appropriately qualified professionals (e.g. doctors, psychotherapists, lawyers).

8.3 Personal responsibility

You are personally responsible for all decisions you make on the basis of the content of a reading or coaching. The liability provisions and exceptions in clause 7.1 remain unaffected.

9. Intellectual property

All content, texts, graphics and materials of the readings, coaching and this website are protected by copyright. Reproduction, distribution or commercial use without express written consent is prohibited.

10. Data protection

Personal data is processed in accordance with our Privacy Policy.

11. Changes to the T&C

Changes to these T&C apply only to contracts concluded after the date of the change. Existing contracts remain unaffected.

12. Final provisions

12.1 Applicable law

The law of the Federal Republic of Germany applies, in particular the BGB (German Civil Code).

12.2 Jurisdiction

The statutory provisions on jurisdiction apply.

12.3 Severability clause

Should any provision of these T&C be invalid, the remaining provisions remain unaffected.
